1. Witnesses will be a tremendous help to you in any subsequent court action, if there is any question of liability involved. Get the names and addresses of as many witnesses as possible. If they refuse to identify themselves, jot down the license plate numbers of their automobiles. Do not discuss the accident with the witnesses. 7. Try to obtain a copy of the police report to make sure all information is correct. If the local police investigated the accident, you can obtain the accident report within a few days. State Police accident reports take several weeks. A Notice of Claim must be filed within 90 days against any person or vehicle owner that is a state, county, city or government entity. This includes public schools, colleges and many hospitals.
Never give a signed statement to the claims adjuster representing the other driver's insurance company. The same goes for a phone recording. They may be used against you in court.
